Exchange Rules
These rules are an agreement between you and us. By creating an order and ticking the consent checkbox, you accept these rules in full. If you do not agree with them, do not use the service.
1.Definitions
- 1.1Service: the obmenkin.com website and everything that runs on it, including rate calculation, order creation, the exchange and sending coins.
- 1.2Client (you): the person who creates an exchange order. No account is needed for this.
- 1.3Order: an exchange of one cryptocurrency for another under a unique number. The order states the pair, the amounts, the rate, the deposit address and the receiving address.
- 1.4Deposit: the coins you send to the address shown in the order. This address is single-use and is valid for one order only.
- 1.5Receiving address: the address of your wallet to which we send the coins after the exchange. You enter it yourself.
- 1.6Tag (MEMO): an additional transfer identifier. Without it, some networks and wallets do not credit the coins.
- 1.7Floating rate: a rate that is set at the moment of the exchange. The final amount may differ from the estimate.
- 1.8Fixed rate: a rate we lock when the order is created. It applies while the timer is running and as long as the deposit amount matches the amount stated in the order.
- 1.9Network confirmation: the inclusion of a transaction in a block. The number of confirmations required to credit a deposit depends on the network.
2.How an exchange works
- 2.1An exchange takes four steps: you choose a pair and an amount, enter the receiving address and send the deposit; we then exchange the coins and send them to you.
- 2.2We create a separate deposit address for each order. Do not send coins to it a second time and do not use it for other orders.
- 2.3The time to send the deposit is limited by the order timer. It is usually 15 minutes for a fixed rate (20 minutes for BTC, XMR, LTC, DCR, EOS, GAS, BNB and VET) and 1 hour for a floating rate. The exact deadline is shown in your order.
- 2.4A deposit is credited after the required number of network confirmations. This number depends on the coin and is shown in the order.
- 2.5The exchange and the payout run automatically. A sent transaction cannot be reversed, so check the receiving address, network and tag before you create the order.
- 2.6An exchange may be delayed by an AML check or network congestion. We are not liable for losses caused by such a delay.
3.Rates and fees
- 3.1The estimate shown on the website is indicative. It may differ from rates on other platforms.
- 3.2With a floating rate, the result depends on the market at the moment of the exchange. If the actual rate differs significantly from the estimate, the order may be rejected automatically. This protects you from large losses.
- 3.3A fixed rate is locked to the order. We exchange at that rate if the deposit arrives on time and in the exact amount.
- 3.4The fee has two parts. The service fee is 0.05% to 3% of the amount you receive with a floating rate; with a fixed rate it is already included in the rate. The network fee pays for sending the coins to your address.
- 3.5You see the amount you will receive, net of all fees, before you create the order. The network fee may change slightly by the time the coins are sent: the network sets it, not us.
- 3.6The network fee is withheld on every payout: after an exchange, on a refund, and on a payout made at the request of a competent authority.
- 3.7If the deposit amount differs from the stated amount but stays within the limits for the pair, we recalculate the amount you receive based on the actual deposit.
4.Sending errors and refunds
- 4.1Common errors: a different amount outside the limits, the wrong network, a transfer without a tag (MEMO), a deposit sent after the timer has expired, a repeat transfer to an address that has already been used.
- 4.2If a deposit arrives late or in a different amount, we will try to complete the exchange manually: at the new rate for a floating-rate order, or at the rate you confirmed for a fixed-rate order. If market conditions do not allow this or you ask for your funds back, we will process a refund.
- 4.3Coins sent via an unsupported or non-recommended network cannot be recovered. The recommended network is shown in the order.
- 4.4We can refund BTC only from a BTC SegWit address. Other coins (for example, LTC, BCH, BSV) sent to a BTC SegWit address are not refunded.
- 4.5To request a refund, message support at @adm_obmenkin with the order number, the transaction hash and the refund address. We send coins only to an address you have confirmed.
- 4.6Refund times: if a floating-rate exchange did not go through, usually 1 to 7 business days after you confirm the address. If the deposit was sent to an address that had already been used, up to 20 business days, because we refund such coins manually.
- 4.7The network fee is deducted from the refund. If handling the error required manual work, we may also deduct operational costs, but only with your prior consent.
- 4.8Refunds after an AML check follow the AML/KYC Policy.
5.AML checks and suspension
- 5.1Every deposit and every receiving address goes through an automatic AML check.
- 5.2We may suspend an order and request information about the source of funds or verification (KYC). This may apply to a specific client, address or transaction.
- 5.3We may refuse to exchange funds linked to fraud or other illegal activity and report them to competent authorities.
- 5.4By ticking the checkbox when you create an order, you confirm that if your funds receive a high risk score, you bear the consequences: suspension, additional checks, delay or a refund.
- 5.5Risk thresholds, time limits and refund terms are set out in the AML/KYC Policy. It forms part of these rules.
6.Restrictions
- 6.1You may use the service if you are at least 18 or, if the law of your country sets a higher age, at least that age.
- 6.2The service is not available to citizens and residents of the United States and its territories (Puerto Rico, American Samoa, Guam, the Northern Mariana Islands, the U.S. Virgin Islands), to persons from countries where cryptocurrency transactions are prohibited, or to anyone who is or has been controlled by such persons.
- 6.3We decide in which countries we operate and may restrict access from any of them at any time. If you use the service from such a country, we will suspend or stop processing your order.
- 6.4You exchange only your own funds of lawful origin. They are not pledged, seized or subject to a dispute, and no third party has rights to them.
- 6.5You may not exchange funds obtained from fraud, illegal gambling, money laundering, terrorist financing or other illegal activity, evade sanctions, or provide addresses linked to such activity.
- 6.6You also may not provide false information, interfere with the service, decompile or hack it, access closed parts of the website, or encourage others to do so.
- 6.7You pay any taxes that arise from your exchanges yourself.
- 6.8If you breach these rules, we may stop serving you immediately and without notice. We may also shut down the service at any time.
7.Liability and risks
- 7.1We do not give investment or legal advice. You decide whether to exchange, and you bear the risk.
- 7.2Cryptocurrency prices are highly volatile. Such assets are usually not protected by the state, so the safeguards of regulated financial services do not apply. You may lose part of the value.
- 7.3We are not liable for failures of blockchains, wallets, exchanges or other third-party services, or for disruptions of communications, hardware or software.
- 7.4A rate difference of less than 5% of the transaction amount caused by third-party algorithms is not our error.
- 7.5You are responsible for the receiving address, network and tag. We are not liable for coins sent to a wrong address or to an address other than the one in the order.
- 7.6The service is provided “as is”. We do not guarantee uninterrupted operation and are not liable for indirect losses or lost profits.
- 7.7Our total liability to you does not exceed the fees you paid us in the 3 months before the claim.
- 7.8We are not liable for failing to perform our obligations due to force majeure: natural disasters, communication failures, government actions, attacks on networks and other circumstances beyond our control.
- 7.9If a claim is brought against us because you breached these rules, you will compensate us for the resulting losses.
8.Support, disputes and changes to the rules
- 8.1Support is available on Telegram: @adm_obmenkin. Include your order number; without it we cannot find your exchange.
- 8.2We communicate with clients only through this Telegram contact. Do not share your order details with anyone else. We ask for information only to complete an order, to respond to your request or when the law requires it.
- 8.3We first try to resolve disputes through support. If we cannot reach an agreement, the dispute is governed by the applicable law.
- 8.4We may change these rules. A new version takes effect when it is published on obmenkin.com; its date is shown at the top of the page. By continuing to use the service, you accept the new version.
- 8.5The website's texts, design, logo and code may not be copied or used for commercial purposes without our consent. We may freely use any feedback and suggestions you send us.
- 8.6If any provision is found invalid, the remaining provisions stay in effect. If we do not exercise a right immediately, this does not mean we waive it.
- 8.7These rules, together with the AML/KYC Policy and the Privacy Policy, form the entire agreement between us. You may not transfer your rights and obligations under it without our written consent; we may transfer ours.
